Le mouvement pour la justice restauratrice : " An idea whose time has come "

For its supporters, restorative justice is a less formal and professional "third way" in criminal matters, between retribution and rehabilitation. The banner is waved on behalf of very different cases: in the interest of the victims, the offenders, the community, etc. It is also waved on behalf of their advocates, when it contributes to the survival of an Anabaptist denomination, to a critical criminology, or to the preservation of paralegal professions. This article analyzes restorative justice as a "movement" that links mobilizations located in different social spaces, thus showing the impoverishment of the reforming ambition of a so-called "radical" social movement.
La "justice restauratrice" ou "réparatrice" (restorative justice) incarne pour ses promoteurs une "troisième voie" pénale, entre rétribution et réhabilitation, informelle et soustraite au monopole des professionnels du droit. Or des groupes très divers y associent la défense de causes tout aussi éclectiques (survie de dénominations protestantes, critique criminologique, invention ou consolidation de professions para-judiciaires, contestation du système pénal ou mise à l'épreuve de théories libérales). En analysant la justice restauratrice comme un mouvement articulant des mobilisations situées dans des espaces sociaux et géographiques éloignés les uns des autres, on montrer aussi la tendance à l'affadissement de l'ambition réformatrice d'un mouvement social qui se voulait "radical".
