Le triple test est-il vraiment central à la protection constitutionnelle des libertés ? Observations sur un standard de contrôle à géométrie variable

Abstract : The “triple test” is often presented as the most advanced proportionality review that the French Constitutional Council may use. With this test, the Constitutional Council can indeed modulate the intensity of its proportionality review. In view of this fact, it seems useful to challenge, based on the recent QPC caselaw, the assertion that this “triple test” is a powerful review which would reinforce the protection of fundamental human rights in the context of the a posteriori constitutional review.
