Dall’illegalismo alla gestione differenziale degli illegalismi: ritorno su un concetto

Abstract : The concept of “illegalism” (and by extension the concept of “differential administration of illegalisms”), which has been elaborated by Michel Foucault during the early 1970s, has visibly re-emerged in recent years, being applied to a various range of topics. This resurgence certainly gives rise to stimulating developments; however, it appears as a mixed success, considering some inaccurate uses of the term as well as misconceptions. The ambition of this article is to take a close look at it for the sake of theoretical clarification, highlighting a semantic and thus a conceptual tension: even though the concept specifically means a relation (to law, to rules), it tends to be directly applied to certain practical infringements.
