La délicate question de la détermination des sanctions pour violation de l'État de droit

Abstract : In order to determine appropriate sanction in case of Rule of law violation, it is necessary, first, to take position on the objective to achieve. Stating that it is preferable to impel states to effective respect of this fundamental value than to simply punish them, and drawing on typology of existing sanctions, this article argue that better to combine low level sanctions than to focus on a dissuasive one as in article 7 TEU.
