Le gel des avoirs : une limitation de la propriété du « terroriste-ennemi » : (Conseil constitutionnel, 2 mars 2016, n° 2015-524-QPC)

Abstract : The Constitutional Council has ruled on the validity of Articles L. 562-1 and L. 562-2 of the Monetary and Financial Code. These allow the Minister of Economy to take administrative policy measures aimed at freezing financial assets of persons committing, attempting to commit or who are likely to commit terrorist acts. These measures are part of the historical lineage of measures that hit the heritage of "enemies" of the contemporary French State. Because they have too broad a concept of the notion of property - of the "enemy" - that may be subject to a freezing order, such measures have been partially censored by the Council.
