Nouvelles précisions sur le régime constitutionnel des servitudes administratives : Conseil constitutionnel, 2 février 2016, n° 2015-518-QPC (JO du 5 févr. 2016, n° 75), AJDA 2016. 176 ; D. 2016. 319

Abstract : The Constitutional Council has been requested to assess the constitutionality of certain provisions of the Energy Code that establish administrative easements, and which allow an electricity company to carry out work on private properties. The Council used a two-stage approach. On the one hand, the easements comply with Article 17 of the Declaration of 1789 because they do not lead to deprivation, provided, however, that they do not empty property rights of their essence. On the other hand, they do not further violate Article 2 of the aforementioned text, as the restrictions of property rights that such easements entail are justified by the public interest and are proportionate.
