L'utilisation de la Constitution dans les contentieux climatiques en Europe et en Amérique du Sud

Abstract : Europe and Latin America have in common to face the rise of a dispute climate change carried by civil society against public authorities. In these trials, the Constitution take a growing place but of varying importance depending on the nature of the actuated procedure. A typology of the use of the constitutional norm may to be proposed, which distinguishes: an objective-type litigation in which the judge is to test the constitutionality of a standard that affects the climate; a litigation involving the State's responsibility for inadequacy of its policy climate; finally, the use of direct action to protect fundamental rights, like amparo, in support of a citizen's climate action.
