Enjeux anthropologique et juridique de la controverse de auxiliis entre Luis de Molina et Domingo Bañes

Abstract : The controversy de auxiliis between Domingo Bañes and Luis de Molina is originally properly theological. It opposes the defenders of a doctrinal system preserving the idea of a grace effective in itself to the proponents of the thesis of a sufficient grace, generally conferred on men once their merits have been foreseen, who achieves full effectiveness under the free will's consent. Its anthropological implications are, however, quite obvious, since it raises the question of how man can exercise his free will if the whole of reality is predetermined by the divine will. The present article shows that, in order to answer it, Molina is led to further theorize the capacity for autonomy possessed by men, by developing its legal consequences, manifested by a real grip of man over the world, while Banez tightens the bond between God and His creature to restore His omnipotence and point out man's dependence on Him. In doing so, he elaborates a definition of the subject based on his autonomy, constituting his dignity. The theological controversy thus raised strong anthropological and legal stakes, which certainly explains why it could not be decided and that it is found in the 17th century at the center of the conflict between Jesuits and Jansenists.
