Le corps et le droit du travail : au cœur d’un paradoxe

Abstract : The specificities of the labor relation lead to a paradox concerning the legal treatment and the legal status of the body at work : the body of the worker is, at the same time, the object of the working performance and the object of the protection of the law. So, in the subordination which characterizes the relation between employer and employee, the latter is often physically forced and gives its body to the employer. Limits at the free possession of the body at work are multiple. Nevertheless, the protection of this body at work was at the origin of the creation of the labor law and the numerous European and international standards. The stake is to guarantee a protection of the rights and the liberties of the person in its entirety without widening infinitely the spatiotemporal limits of the subordination of the worker.
