L’influence du droit européen et international des contrats sur la réforme française du droit des obligations

Abstract : The Ordonnance portant Réforme du Droit des Contrats, du Régime Général et de la Preuve des Obligations (10 February 2016) is part of the Europeanisation and Internationalisation of contract law. The official report accompanying the ordonnance publication explicitly refers to some projects (PECL, DCFR, Unidroit Principles, etc.); these projects are both seen as contextual elements and as inspiring sources for specific new solutions. However, we have been witnessing a kind of instrumentalisation: the uses of the projects are selective – only to justify some innovations – and sometimes they are even improper. In particular, the report presentation is reductive: the movement, which the French reform is part of, is not confined to these projects, it is also fuelled by international conventions and many national reforms in this field. In this context, we acknowledge the convergence of many solutions that could be highlighted. In addition, the European and International influence over the ordonnance appears to be less direct than the report presentation.
