Juristes en coopération. Magistrats et professeurs de droit en Algérie (1962-début des années 1980)

Abstract : The independences, which ended in theory in the sovereignty of the young nations, did not dedicate the end of the link between ex-colonized and colonizing countries. This link was transformed into “cooperation” i.e. into a material and human help in the technical and cultural domains framed by bilateral agreements. Even in Algeria where the independence resulted from a war of almost eight years, the cooperation was organized and allowed a real continuity of the functioning of public service. This period of transition, extremely attractive, has not aroused keen interest in the historiography. The studies on the jurists are rare while these men represent one of the main actors of the State machinery. Professors and magistrates in particular are important because they “think”, transmit, contribute to the elaboration of the Law and sometimes to its application. These two professional categories do not however appear in a homogeneous way in Algeria, in particular as for their motivations to stay or to come in cooperation. Beyond their similarities or beyond their differences, their presence, their ambitions and their action put into question the notions of commitment and ideology, of intellectual and linguistic exile, the nature of transfers, reappropriation and “feedback” operated in the legal, methodological fields and in the professional practices in Algeria, but also in France.
