L’ordonnance du TIDM en prescription de mesures conservatoires dans l’affaire de l’Incident de l’Enrica Lexie (Italie c. Inde), ou de l’art délicat de naviguer entre deux eaux

Abstract : Since 2012, the Enrica Lexie case poisoned relationships between India and Italy. While two Italian marines were prosecuted before Indian courts, Italy requested the International Tribunal for the Law of the Sea to prescribe provisional measures. The order, delivered on 24 August 2015, is interesting in more than one respect. On the one hand, the Tribunal decides but does not prove that the requirements to prescribe provisional measures are met. On the other hand, the decision reflects the concern to pronounce the most well-balanced decision for both parties. Finally, the question could be raised whether the silences of the order reveal the embarrassment of ITLOS, which was instrumentalized in an Italian judicial strategy both ambiguous and uncertain.
