Examen sceptique de la distinction entre motifs juridiques et motifs non-juridiques

Abstract : The paper discusses whether would it be relevant to distinguish between legal and non legal reasons in legal decisions and focus on the presuppositions of the distinction. Then the paper examines Robert Alexy's "Special-Case Thesis" and ends with a realist view of legal reasoning as practical reasoning, focusing on legal styles.
