Forcer le droit à parler contre la burqa. Une "Judicial politics" à la française ?

Force the law to speak against the burqaThis article traces the controversy generated by the political enterprise to legislate against full veils in the public space in France. The decisionmade in 2010 by the Conseil Constitutionnel validating the law and putting an end to the constitutional controversy could be interpreted as the byproduct of both a legicentric tradition and the French assertive secularism. Yet, stating this tells nothing about how this decision was made possible. Delving into the lawmaking process, the article shows how seriously the constitutional law has been taken into account and follows the way political stakeholders and legal experts have disputed and adjusted with one another. It highlights the virtue of process-tracing analysis to understand, how constitutional law frames the political game and determines the path of the law, and conversely how political and legal stakeholders manage to enlist the law to their political enterprise, forcing it to speak against full veils.
Cet article retrace la controverse constitutionnelle à laquelle a donné lieu l’entreprise politique visant à interdire, par la loi, le port du voile intégral dans l’espace public en France. À rebours d’une lecture macrosociologique qui verrait dans la validation constitutionnelle de la loi (7 octobre 2010), le résultat quasi mécanique d’un modèle national marqué par la laïcité et une tradition légicentrique, on s’attache à montrer le travail politique qu’a nécessité le contournement de la laïcité et de l’obstacle constitutionnel pour faire parler le droit constitutionnel contre la burqa. Au-delà du suivi de cette controverse politico-juridique singulière qui entérine le déclin d’une laïcité libérale, l’article pointe l’intérêt d’une approche processuelle des décisions constitutionnelles, laquelle consiste à les analyser en perspective des séquences qui les précédent.
