Les conceptions de l'aide familiale aux personnes âgées dépendantes à travers le droit (Allemagne, Angleterre, Belgique, France, Italie, Portugal)

Abstract : The article consists of a comparative analysis of the various legislative measures taken for the inclusion of family solidarity in organising the care of older dependent people. It appears that when social legislation relies on family ties, two issues are involved, sometimes within the same national legislation: the first is to re-establish family solidarity when it seems to be declining and the second to support it when it seems effective. The article points out that British legislation is different in that the solidarity ties taken into consideration are at the same time both scarcer (they are limited to the other partner within the couple) and wider (they include people who are close but not members of the family). This raises the question of close proximity solidarity in the care of dependent older people.
