Déviance en ligne : Enquête sur les serveurs illégaux de jeux vidéo

Abstract : A private server designates the dissenting replica of an online video game "central server". This copy replicates elsewhere the entire video game under the authority of an independent operator of the original game. This replication is problematic for the owner company of the original game, since these software copies violate the copyright and sometimes offer the opportunity for the player to pay bonuses in money to ease his progression in such parallel game. In fact, if he manages to attract massive audiences, the operator of such a dissident server attracts profits that can worth up to several tens of thousands of euros in a few months. How far are willing to go the employees of the owner company in charge of punishing private servers' operators to achieve their moral purpose? We will try to answer this question by describing the social and technical interactions that lead them to identify suspects and offenders among all stakeholders of private servers, as well as to choose the penalties to applicable. These sanctions can often be seen as attenuated punitive forms, as they are based on the simple threat of a lawsuit intimidation, rather than on fines or prosecutions.
