Viols et genres. Fonctions du droit et des procédures judiciaires dans la construction et la déconstruction des paradigmes de l'épistémologie du genre

Abstract : The traditional essentialist and heterocentered paradigm of relations between gender and sexual violences defines women as natural victims of men. It is discernible in legislations against sexual violence and their judicial treatment, which operate as selection filters of these violences. Thus, many scientific studies on sexual violences based on judicial and forensic facts legitimate a posteriori the binary and heterocentered representation of sexuality, and marginalize homosexual violences, male victims and female agressors. If this paradigm seems to support fights against violence on women, it strengthens insidiously political dominations. Discourses focusing on Violence Against Women (VAW) aim to deprive women of their political agency, because they confine them in the roles of victims whose bodies needs protection.
