Du brouillage des catégories de réfugié et de demandeur d'asile à partir d'exemples moyen-orientaux

Abstract : This article proposes a global approach of the question of the refugees and the asylum seekers in the Middle East - more specifically based on the Lebanese and Palestinians refugees in Iraq cases -, by showing that beyond the specificities of every group, the treatment of the question of the asylum does not rely on clear and established legal bases, but on one a whole series of practices that maintain – at various degrees - in precariousness these populations. A difference thus appears between the statutory refugees who benefit from a formal recognition, and those whom we can qualify as refugee, but who for various reasons which are clarified in this article cannot obtain the refugee's status and who fall under the category of analysis of "refugee", these last ones having been forced to leave their country and look for asylum or a form of protection in a third State (these last ones form the main part of the forced migrants in the Middle East)
