L'intention en acte
Résumé
This paper attempts to demonstrate how prosecutors organize their work around the establishment of criminal intention, and shows how legal theory has considered intention as a philosophical question independent from the institutional context of its use. The author promotes a praxiological approach that considers the question of intentionality as the result of interactions which are embedded in the judicial institutional setting. This setting constrains professional actors to focus on the production of a legally relevant decision. In conclusion, it looks at how lay people adjust to this constraining institutional context.
L'article vise à montrer comment les procureurs organisent pratiquement leur activité autour de l'établissement de l'intention criminelle et souligne comment la théorie du droit a surtout cherché à saisir l'intention comme une notion philosophique indépendante du contexte institutionnel de sa mobilisation. L'auteur propose ensuite une approche praxéologique qui voit dans cette question de l'intentionnalité le résultat d'interactions s'insérant dans le contexte institutionnel judiciaire, lequel contraint les acteurs professionnels à s'orienter vers la production d'une décision juridiquement pertinente. En conclusion, il observe comment les acteurs profanes s'ajustent à ce contexte institutionnel contraignant.
