El pleito civil como fuente para la historia social
Résumé
We support the view that civil lawsuits have been too long underrated as a source for social history and must be reevaluated as such. We show it through the analysis of two aleatorily selected cases from the Granada Chancery. They allow us to describe the ways and means through which a wealthy family of Extremadura, a branch of the Ovando of Caceres, in the second half of the XVIIth century, succeded in defending their monetary investments within a context of recession. The wealth of data they contain demonstrates their usefulness for the kind of research that the present state of art demands. In a second part, we very succinctly describe the structure of the lawsuit; we try and give some keys for its undersanding. We underline the fact that its approach is no so complex as is usually thought and remains within reach of any adequately trained researcher.
Defenderemos la tésis de que el pleito civil es una fuente esencial y muy infravalorizada para la historia social. Fundamentaremos nuestra demostración en el analisis de dos pleitos escogidos practicamente al azar en los fondos de la Chancillería de Granada. Enseñaremos con ellos los medios por los que una rica familia de Exrtremadura, una rama de los Ovando de Cáceres, consiguió en la segunda mitad del siglo XVII salvaguardar sus intereses financieros en un contexto de recesón económica. La riqueza de la aportación documental de la fuente nos dispensará de toda ponderación ulterior. Intentaremos luego dar una ligera idea de la forma en que se organiza un expediente, mostrando que su manejo no resulta más difícil que el de un proceso criminal, y en todo caso al alcance del historiador, mediante un entrenamiento razonable..
